Former Attorney-General and Minister of Justice, Nii Ayikoi Otoo, has voiced his displeasure with the New Patriotic Party’s (NPP) legal team for failing to include National Democratic Congress (NDC) Parliamentary Candidates in their application for a mandamus order.

 Mr. Otoo argued that the omission overlooked the rights of critical stakeholders in the ongoing electoral disputes.

“Personally, I have a problem with the NPP lawyers who went to court because we all know there are interested parties in this matter,” he said.

“Usually, when you have a case like this, you must include the interested parties.

So, clearly, why do you leave them out?”

His comments follow a Supreme Court ruling on Friday, December 27, which nullified the re-collation of votes in the Tema Central, Ablekuma North, Techiman South, and Okaikwei Central constituencies.

The apex court ruled that the Electoral Commission’s (EC) re-collation violated the NDC Parliamentary Candidates’ right to a fair hearing, as their concerns had not been adequately addressed during the process.

The court also invalidated the EC’s re-collation results for the disputed constituencies but clarified that the ruling did not affect the election results for Ahafo Ano North and Nsawam Adoagyiri Constituencies.

While keeping the application for a mandamus order active, the Supreme Court directed that the matter be reassigned to a different judge at the High Court for a hearing on Tuesday, December 31.

Mr. Otoo underscored the need for inclusivity in legal proceedings, warning that the exclusion of key stakeholders could complicate the resolution of electoral disputes and erode public trust in the judiciary.
