Labianca case: High Court quashes OSP report, awards ₵10,000 costs against OSP
A High Court in Accra has overturned a report by the Office of Special Prosecutor (OSP) that accused two individuals in the Labianca case of wrongdoing.
The court has further awarded costs of GHS 10,000 against the OSP.
The OSP's report targeted a former Commissioner of the Customs Division at the Ghana Revenue Authority (GRA), Colonel Kwadwo Damoah, and a former Deputy Commissioner of the Division, and Joseph Adu Kyei, alleging their involvement in wrongdoing related to the Labianca Company, a frozen foods company owned by Council of State member Eunice Jacqueline Buah Asomah-Hinneh.
In November 2022, Colonel Damoah and Mr Kyei filed a lawsuit against the OSP, contending that the report lacked merit and had adversely affected their reputations.
The High Court, in its ruling, sided with the plaintiffs, affirming that the OSP had exceeded its authority in making adverse findings.
Additionally, the court granted an order of prohibition, preventing the OSP from further investigating Colonel Damoah and Mr Kyei in connection with the Labianca case.
The lawyer representing the plaintiffs, Bob Senyalah, welcomed the court's decision, describing it as a victory for justice.
He stated: “The court awarded GHS 10,000 cedis cost against ASP. The court further granted an order of prohibition restraining the OSP from purporting to continue or conduct further investigations against the applicant.”
Lawyer Senyalah emphasised that this ruling would go a long way in restoring the reputations of his clients, who had been unfairly affected by the OSP's report, stating they had been “dragged through the mud.”
