CDM questions impartiality of committee probing Chief Justice

The Centre for Democratic Movement (CDM) has raised serious concerns over the neutrality of the committee established to investigate Chief Justice Gertrude Torkornoo, describing it as politically compromised and lacking credibility.

In a statement, the group argued that the current composition of the committee undermines both actual and perceived impartiality, casting doubt on the integrity of the process.

“The make-up of the investigative committee is marred by political affiliations and past controversies,” CDM stated, pointing to the inclusion of former Auditor-General Daniel Domelevo, Justice Gabriel Pwamang, and Prof. James Sefah-Dzisah.

The group questioned their ability to remain impartial in such a politically sensitive matter.

CDM acknowledged the presence of Justice Asiedu, an appointee from the previous administration, but said his inclusion alone was not enough to balance the perceived bias.

“This lone balance does little to counter the perception that the body is overwhelmingly tilted toward the Executive’s interests,” the group noted.

Citing the United Nations Basic Principles on the Independence of the Judiciary and the African Commission’s Principles on Fair Trial, CDM asserted that the current structure of the committee violates international standards.

These frameworks, the group emphasised, require impartial and constitutionally sound mechanisms for judicial discipline.

In light of these concerns, CDM is calling for the immediate dissolution and reconstitution of the committee, demanding a new body composed of “truly independent and politically neutral” individuals.

 

The group warned that failure to act could erode domestic trust in the process and tarnish Ghana’s democratic image on the global stage.
